REPORT WARNS THAT VULNERABLE ADULTS ARE BEING LET DOWN BY SOCIAL WORKERS AND CARE PROVIDERS

  • A report has warned that vulnerable adults are being let down by social workers and care providers who fail to follow the Mental Capacity Act, Community Care, reports.

    According to the Local Government and Social Care Ombudsman review:

    • One in five social care complaints made to the service in 2016 dealt with mental capacity or deprivation of liberty cases
    • Details of cases with common issues with MCA and DoLS were published
    • A victim of stroke was placed in care home against his will after social workers made assumptions about his capacity without assessing it well
    • There are problems of delays with councils and care providers applying for a DoLS authorisation
    • Some councils and care providers did not understand the decision-making process of some investigations

    Local government and social care ombudsman, Michael King, said:

    "While I appreciate the complex emotional and practical decisions social workers need to make, the people they look after are still entitled to be treated fairly, and have their assessments undertaken correctly and in a timely."
