New law enables housing association to issues injunctions on young people
- 09 Jun
A new type of injunction by Sevenoaks Youth Court has been awarded to Golding Homes housing association against an under eighteen year old for anti-social behaviour.
This injunction has been awarded under the Anti-Social Behaviour, Crime and Policing Act 2014, and is this first time the housing association, barrister and court have made use of the new powers to obtain an injunction order against an under-18 year old since they became available on 23rd March 2015, reports 24dash.
The ‘without notice’ injunction has been granted against a 17 year old male who threatened a Golding Homes tenant, their family, and property. The interim injunction sets an exclusion area around the estate in Maidstone and if the man is witnessed breaching the exclusion area the police have the power to arrest him.
Stephen Timms, Golding Homes Community Safety Advisor, said: “It doesn’t matter what age you are, or if you are a Golding Homes resident or not. If you cause anti-social behaviour that affects our residents, we will take action against you using whatever powers are available to us”.
Sarah Christy, senior solicitor of Capsticks Solicitors, who are housing management specialists and who represented Golding Homes said “We were delighted to support Golding in the use of the new powers available to them to this action. We believe that this is one of the first applications of its kind in the country, and it demonstrates that the legislation works to provide a quick and efficient remedy against perpetrators of anti-social behaviour who are under 18”.
